1. INTRODUCTION & BUSINESS DETAILS
These Terms of Service govern your access to and use of harmansgadgets.com, including any purchases made. By placing an order, you agree to be bound by these Terms.

2. PRODUCTS

We sell brand new and A-grade pre-owned mobile devices and accessories. All product descriptions, specifications, images, and pricing are provided in good faith. We reserve the right to correct errors in pricing, stock levels, or product descriptions and to cancel affected orders with a full refund.

3. PRICING & PAYMENT
3.1 All prices are quoted in South African Rand ZAR 
3.2 Payment methods: EFT, Credit/Debit Card and Lay-by.
3.3 An order is only confirmed once payment is received in full, or once a minimum 20% deposit is received for lay-by orders.
3.4 We reserve the right to verify payment and billing details before processing any order.

4. LAY-BY AGREEMENT
4.1 A minimum 20% deposit is required to secure an item and remove it from available stock.
4.2 The outstanding balance must be paid in full before the item is delivered or collected.
4.3 CANCELLATION BY CUSTOMER
If you cancel the lay-by agreement before the final payment is made, an administration/cancellation fee will apply to cover processing and admin costs. The fee will be 10% of full price. No cash refunds will be issued on cancelled lay-by deposits.
4.4 CANCELLATION BY HARMANS GADGETS
If we cancel due to stock errors, pricing errors, or supplier issues, your full deposit will be refunded to your original payment method within 7 business days.

5. ORDER PROCESSING & DELIVERY
5.1 Order processing: 1 business day for in-stock items. Lay-by orders process within 1 business day after final payment is confirmed.
5.2 Delivery is estimated to be 2-4 business days nationwide via [courier]. Tracking information will be sent to your email/SMS once dispatched.
5.3 Risk of loss and title for items pass to you upon delivery. Please inspect your package on delivery. Report any damage within 48 hours.

6. RETURNS & WARRANTY
6.1 Change of mind: 14-day return window from date of delivery. Item must be unused, in original packaging with all accessories.
6.2 Faulty/Warranty: See our separate Return and Refund Policy for full warranty terms. Brand new devices carry manufacturer warranty. A-grade devices carry a 3-month Harmans Gadgets warranty covering hardware faults. Warranty excludes physical damage, liquid damage, unauthorized repairs, and normal battery wear.
6.3 Restocking fee: 10% restocking fee applies only if device is activated/IMEI registered. No fee for sealed, unopened returns.

7. CUSTOMER RESPONSIBILITIES
You must provide accurate delivery and contact details. You are responsible for checking the device on receipt. Any attempt at unauthorized repair will void warranty.

8. LIMITATION OF LIABILITY
To the maximum extent permitted by South African law, Harmans Gadgets will not be liable for any indirect, incidental, special, or consequential damages. Our total liability shall not exceed the amount you paid for the product.

9. PRIVACY
Your personal information is collected and used in accordance with our Privacy Policy and the Protection of Personal Information Act POPIA. We will not sell or share your data with third parties except as required for order processing.

10. CANCELLATION & REFUSAL OF SERVICE
We reserve the right to refuse service, cancel orders, or close accounts at our sole discretion if we suspect fraudulent activity, abuse, or violation of these Terms.

11. GOVERNING LAW
These Terms are governed by the laws of the Republic of South Africa. Any disputes will be subject to the exclusive jurisdiction of South African courts.

12. CHANGES TO TERMS
We may update these Terms from time to time. The “Last updated” date will reflect changes. Continued use of our website after changes means you accept the updated Terms.
